Please read these Terms of Service carefully before using the arii/hrm application. By accessing or using our service, you agree to be bound by these terms.

1. Acceptance of Terms

By using arii/hrm, you agree to these Terms. If you do not agree, please do not use the application. These terms constitute a legally binding agreement between you and arii/hrm.

2. Service Description

arii/hrm is an open-source development project provided for educational and recreational testing. It visualizes local Bluetooth data and provides experimental integrations.

Project Status:

This application is in Active Development. Features, specifically Strava integration, may be incomplete or simulated. Use strictly at your own risk.

Key Features:

Real-time heart rate monitoring via Bluetooth Low Energy (BLE) devices
Integration with Strava for activity tracking (In Development)
Integration with Spotify for music control during workouts
Local data processing with no server storage
Workout timer and heart rate zone visualization

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. We make no guarantees about the accuracy, reliability, or availability of the service.

You acknowledge and agree that:

You use this application at your own risk
The heart rate data displayed is for informational purposes only
You should not rely on this application for medical decisions
You are responsible for your own physical safety during workouts
You should stop exercising and seek medical attention if you experience any discomfort

4. Third-Party Services

This application integrates with third-party services. Your use of these services through our application is subject to their respective terms and policies.

Strava Integration

By connecting your Strava account, you agree to:

Strava's API Agreement

Strava Compliance: We comply fully with Strava's Brand Guidelines and API Agreement. We use Strava data solely to provide arii/hrm functionality and do not store, manipulate, or share your Strava data with third parties.

Spotify Integration

By authorizing Spotify, you agree to:

Spotify's Privacy Policy
Spotify's Developer Terms

Important Spotify Restrictions:

Non-commercial use only
Do not sell or redistribute Spotify content
Do not extract or scrape Spotify data
All Spotify content is attributed to Spotify

Third-Party Service Changes

We do not guarantee the continued availability of third-party integrations. If Strava or Spotify changes their APIs, modifies access, or changes their Terms of Service, these features may cease to function without notice. We are not responsible for changes made by third-party services.

5. User Responsibilities

By using this application, you agree to:

Use the Strava and Spotify integrations only in accordance with their respective Terms of Service
Not attempt to reverse engineer or scrape data from the application
Not attempt to circumvent any security measures
Take full responsibility for your physical safety during workouts
Provide accurate information when setting up your account or profile
Maintain the security of your connected accounts
Use the service only for lawful purposes

Account Security: You are responsible for maintaining the confidentiality of your login credentials for connected services. Notify us immediately of any unauthorized use of your account.

6. Prohibited Uses & AI/ML Restrictions

You may NOT use this service to:

Train Artificial Intelligence (AI) or Machine Learning (ML) models using user data (including heart rate data, Strava activity history, or Spotify listening habits)
Extract, scrape, or harvest data for any purpose other than personal use within the application
Create derivative products or services based on user data
Sell, license, or redistribute any data accessed through this application
Violate any applicable laws or regulations
Infringe on the intellectual property rights of others
Transmit malicious code or interfere with the service
Impersonate others or provide false information

Data Protection: We explicitly guarantee that no user data (including Heart Rate data, Strava activity history, or Spotify listening habits) will be used to train Artificial Intelligence (AI) or Machine Learning (ML) models, either by us or by third parties.

7. Intellectual Property

The arii/hrm application, including its design, code, and original content, is owned by us and protected by copyright and other intellectual property laws. Third-party trademarks and content (Strava, Spotify, Garmin) remain the property of their respective owners.

You may not:

Copy, modify, or distribute our application code
Remove any copyright or proprietary notices
Use our branding without permission

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

arii/hrm shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of, or inability to use, this service or its third-party integrations. This includes, but is not limited to, damages for loss of data, loss of profits, personal injury, or any other losses.

We are not responsible for:

Inaccuracies in heart rate data from Bluetooth devices
Interruptions or errors in service availability
Changes or discontinuation of third-party APIs (Strava, Spotify)
Any injuries sustained during physical activity while using the app
Loss of data due to device or browser issues
Unauthorized access to your accounts

9. Indemnification

You agree to indemnify and hold harmless arii/hrm, its developers, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the service
Your violation of these Terms
Your violation of any third-party rights
Any injuries or health issues related to your use of the application

10. Service Modifications and Termination

We reserve the right to:

Modify or discontinue the service at any time without notice
Update these Terms of Service (continued use constitutes acceptance of modified terms)
Terminate or suspend access to the service for violations of these terms
Remove or disable third-party integrations if required by API providers

You may stop using the service at any time. To disconnect third-party services, use the Settings menu or revoke access directly through Strava or Spotify.

11. Privacy and Data Collection

Your use of this service is also governed by our Privacy Policy. Please review it to understand how we handle your data.

Key Privacy Points:

We do not store your health data on servers
All processing occurs locally in real-time
You can disconnect third-party services at any time
We comply with Strava and Spotify data usage policies

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where arii/hrm operates, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class action lawsuits.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and arii/hrm regarding the use of the service and supersede any prior agreements.

15. Updates to Terms

We reserve the right to modify these terms at any time. Continued use of the service after changes constitutes acceptance of the modified terms. We will update the "Last Updated" date at the top of this page when changes are made.
